What Can I Recover?

There are different types of work injury compensation options. In Texas, only public employers are required to carry workers’ compensation. Legally, all businesses are required to notify their employees if they do or do not hold such coverage. If you are eligible for workers’ compensation, these benefits provide a replacement for your wages and medical treatment and can provide vocational rehabilitation if you cannot return to your job due to your injuries. To receive these benefits, you must report your injury to your employer within 30 days. In some situations, employees have the right to waive their workers’ compensation benefits, allowing them to retain their right to sue their employer.

If your employer does not have workers’ compensation, or you have waived your right to it, a personal injury claim can help ease financial difficulties due to your injury. It may also cover non-financial damages, like pain and suffering. This is the main difference between the two: when you recover damages via workers’ compensation, you give up your right to sue. Therefore, nonfinancial damages cannot be recovered.
